GENERAL TERMS AND CONDITIONS OF SALE OF CHÂTEAU HAUT NOUCHET
Article 1 - Purpose and Scope of Application
Any product order implies unconditional acceptance by the buyer and full adherence to these general terms of sale, which take precedence over any other buyer’s document, notably any general purchasing conditions, unless expressly agreed otherwise in advance by our company.
These general terms of sale apply to all product sales by our company unless a specific written agreement is made prior to the order between the parties.
Consequently, placing an order by a customer entails unconditional adherence to these general terms of sale unless special conditions are agreed upon in writing by our company with the purchaser.
Any document other than these general terms of sale, including catalogs, brochures, advertisements, or notices, is for informational and indicative purposes only and is non-contractual.
Article 2 – Order :
An order shall mean any order for our products listed in our pricing, accepted by our company, and accompanied by the deposit payment, as noted on the order form if applicable.
The wines listed on price lists and order forms are offered within the limit of available stock at the time of ordering and for a specified duration.
Orders sent to our company are irrevocable for the client, except with written acceptance from us. Any information provided by the client at the time of ordering is binding. Therefore, our company cannot be held liable for consequences arising from errors in the labeling of the recipient's details provided by the ordering client.
Any request to modify the composition or volume of an order placed by a client can only be taken into account by our company if made in writing, including via email, and received by our company no later than 48 hours after the initial order receipt. In the case of order modification by the client, our company will no longer be bound by the agreed delivery times for execution.
Article 3 -Withdrawal Period :
In accordance with Articles L121-20 and following of the Consumer Code, the client has a period of 7 clear days from the date of order delivery to return the product for exchange or refund, in its original packaging and in good condition, suitable for resale.
The period starts from the day of receipt of the goods until the return package's shipping date.
The company agrees to refund the client in full for the paid amounts (except for shipping and return costs) within a maximum of 15 days upon receipt of the returned merchandise.

Article 5 – Deliveries :
Article 5-1 - Deadlines
France: no later than 14 days depending on the department in most cases.
Delivery times are for informational and indicative purposes only; they depend on carrier availability and the order in which orders are received.
Our company strives to respect the delivery times indicated based on the reference logistics timeframe in the profession and to fulfill orders, except in cases of force majeure or circumstances beyond our control, such as strikes, frost, fire, storms, floods, epidemics, supply difficulties, and more. Delays in delivery cannot give rise to any penalty or indemnity, nor justify cancellation of the order.
Article 5-2 – Risks
Risk transfer on products sold by our company occurs upon handing over to the carrier.
Article 5-3 – Transport
It is the client's responsibility to make all necessary claims with the carrier in case of damaged or missing goods. Any product not subject to reservations by registered letter with acknowledgment of receipt within 48 hours of receipt with the carrier, and a copy sent simultaneously to our company, will be deemed accepted by the client.
Article 5-4 - Reception
Without prejudice to the provisions to be taken by the client with the carrier as described in Article 5-3, in the case of visible defects or missing items, any claim concerning delivered products will only be accepted by our company if made in writing, by registered letter with acknowledgment of receipt within the 48-hour period specified in Article 5-3.
The buyer is responsible for providing all proof of observed defects or missing items.
No merchandise return may be made by the client without our company's prior express, written agreement, obtained particularly by email.
Return costs will be covered by our company only if an apparent defect or missing items are indeed observed by the company or its representative.
Only the carrier chosen by our company is authorized to handle the return of relevant products.
If, upon inspection, an apparent defect or missing items are indeed observed by our company, it will replace the non-compliant items and/or supply missing items at its own expense, with no additional indemnity claimable by the client.
Acceptance of ordered products without reservation by the client covers all apparent defects and/or missing items.
A claim by the buyer under the conditions and procedures described in this article does not suspend payment by the client for the relevant goods.
Our company’s liability cannot be invoked in any case for events during transport, such as destruction, damage, loss, or theft, even if the carrier was chosen by the company.
Article 6 - Pricing - Fees - Shipping Costs:
Our prices are set by the prevailing rate on the date of order placement. They include all taxes. Shipping costs are calculated based on the order weight and necessary packaging for shipment.
They are based on the property or are free from shipping costs for orders of 300 euros or more within mainland France. A shipping fee will apply for any order below 300 euros.
Article 7 – Obtaining an Invoice:
Château Haut Nouchet automatically sends you your invoice by email following your purchase.
Article 8 – Payment Methods:
You can pay for your orders on the Château Haut Nouchet online wine store by secure credit card payment (MasterCard, Visa, etc.) with our partner CYBERPLUS BPACA.
